Probate & Estate Planning Certificate Program Elective Seminar

Identify Planning Gaps, Protect Client Autonomy, and Document Your Judgment

A sound estate plan may still fail if legal authority, care arrangements, public benefits, private resources, and family support do not work together. Learn to uncover care and disability-related needs, coordinate planning tools with the client’s objectives, clarify the roles of supporters and fiduciaries, and prepare for changes before a client or beneficiary must rely on the plan.

Work through evolving hypotheticals involving decision-making, influence, and competing interests. Apply supported decision-making, ethical duties, and safeguards against exploitation. Strengthen your process for deciding whether to proceed, seek more information or professional input, modify the proposed approach, or decline the engagement, and document why.

You will be able to:

  • Use evolving hypotheticals to identify gaps and choose practical responses
  • Coordinate legal tools, care, benefits, resources, and support networks
  • Preserve autonomy while assessing capacity, influence, and exploitation
  • Evaluate safeguards and define roles for supporters and fiduciaries
  • Choose a course of action and document the reasons for your decision
