A lawyer in private practice since 1982 and a registered certified public accountant, Nancy H. Welber concentrates her practice in the areas of estate and retirement planning and probate and trust administration. In the retirement realm, she assists clients and other lawyers with difficult planning and drafting issues for families with significant retirement benefits, including families with special needs or younger beneficiaries and charitably inclined clients with large retirement accounts; in drafting for complex retirement planning situations; and with rectifying insufficient required minimum distributions by the account owner or beneficiary. In the trust administration area, Ms. Welber works with client families and consults with other lawyers on postmortem issues, including disclaimers of retirement benefits, administering trusts with problematic beneficiaries for retirement benefits such as charities, and distributing retirement accounts from trusts to the beneficiaries without triggering income tax. Ms. Welber is of counsel to Mall, Malisow & Cooney, PC, in Farmington Hills, and Ferguson Widmayer & Clark, PC, in Ann Arbor. She is a fellow of the American College of Trust and Estate Counsel (ACTEC), a member of the ACTEC employee benefits and elder law committees, and a former member of the State Bar of Michigan's Probate and Estate Planning Council, where she still serves as chair of the Probate and Estate Planning Council Assisted Reproductive Technology Ad Hoc Committee. Ms. Welber frequently lectures on estate planning with retirement benefits and other estate planning topics. She is a member of the Retirement Benefits Committee for "Trusts & Estates" magazine and has contributed articles covering planning for disabled and chronically ill beneficiaries after the SECURE Act (April 2020 and June 2023) and trust administration for retirement benefits payable to a trust with individual and charitable beneficiaries (June 2021).
