Driving offenses involving intoxicants are continuing to evolve as offenders' habits shift away from alcohol use toward other controlled substances, especially marijuana. Law enforcement tools such as drug recognition experts (DREs) and roadside saliva testing are rapidly becoming common place and require the attention of defense lawyers. Additionally, while they have been in use for decades, ignition interlock devices (IIDs) continue to provide offenders a clear path to license restoration.

  • Determine if your client can claim medical marijuana immunity in driving offenses
  • Use IID monitoring as a tool for plea negations or agreeing to terms of probation
  • Confirm officers are following established DRE training and procedures
