Solely for the Benefit of a Spouse Trust
New Form
Assets in a solely for the benefit of a spouse trust are not available assets for Medicaid purposes as long as there are no circumstances under which payment to the trust could be made to or for the benefit of the institutionalized spouse. This new sample trust allows a Medicaid applicant to divest assets to a spouse and achieve Medicaid eligibility with minimal difficulty.

Motion to Restore Appellate Rights
New Form
Amendments to MCR 6.428 effective January 1, 2021, provide that a defendant who was denied the right to appellate review or the appointment of counsel for certain enumerated reasons is entitled to have that right restored. This recent addition to ICLE's Formbank is a sample motion, made in the trial court, to restore these rights.
