Amendments to MCR 3.214 and MCR 8.117

     On order of the Court, notice of proposed amendments having
been waived, the following amendments to Rules 3.214 and 8.17 of
the Michigan Court Rules are adopted, effective June 1, 1997.

     The rules are amended as follows:


Rule 3.214     Actions Under the Revised Uniform Reciprocal
               Enforcement of Support Act (RURESA) and the
               Uniform Interstate Family Support Act (UIFSA).

     (A)  Governing Rules.

          (1)  Actions under the Revised Uniform Reciprocal
               Enforcement of Support Act, MCL 780.151 et
               seq.; MSA 25.225(1) et seq., and the
               Uniform Interstate Family Support Act, MCL
               552.1101 et seq., are
               governed by the rules applicable to other civil
               actions, except as otherwise provided by that act
               and this rule.

          (2)  "Support Order," as used in this rule, for
               RURESA cases is defined by MCL 780.153b(8);
               MSA 25.225(3b)(8), and for UIFSA cases is
               defined by MCL 552.1104 (i).

     (B)  [Unchanged.]

  (C)  Sending Notices in UIFSA cases. The friend of the court
          office shall send all notices and copies of orders
          required to be sent by the tribunal under the Uniform
          Interstate Family Support Act, MCL 552.1101 et seq.


Rule 8.117     Case Classification Codes

(A)  [Unchanged.]

(B)  Case-Type Code List; Circuit and Recorder's Court.  The
     following case-type code list must be used as provided in
     subrule (A).  The bracketed letters are the case codes.

     (1)-(3) [Unchanged.]

     (4)  Domestic Relations.

          (a)-(u)[Unchanged.]


       (v)  UIFSA Establishment [UE]. All support and
               paternity establishment proceedings incoming from
               another state under the Uniform Interstate Family
               Support Act.

          (w)  Registration of Income Withholding Orders [UW]. 
               All incoming  registrations of another state's
               orders for the specified purpose of income
               withholding only under the Uniform Interstate
               Family Support Act.

          (x)  Registration of Orders for Enforcement [UN].  All
               incoming registrations of another state's orders
               for the specified purpose of enforcement only
               under the Uniform Interstate Family Support Act.

          (y)  Registration of Orders for Modification [UM].  All
               incoming registrations of another state's orders
               for the specified purpose of modification under
               the Uniform Interstate Family Support Act.

          (z)  Assist with Discovery [UD]. All proceedings under
               the Uniform Interstate Family Support Act to
               assist with discovery, or to compel a response to
               a discovery order issued by another state's
               tribunal.

          (aa) UIFSA Initiation [UI].  All support and paternity
               establishment proceedings outgoing to another
               state under the Uniform Interstate Family Support
               Act.

          (bb) UIFSA Filing - Income Withholding [UO]. All
               outgoing requests for registration of another
               state's order for the specified purpose of income
               withholding only under the Uniform Interstate
               Family Support Act.

          (cc) UIFSA Filing---Enforcement [UF].  All outgoing
               requests for registration of another state's order
               for the specified purpose of enforcement only
               under the Uniform Interstate Family Support Act.

          (dd) UIFSA Filing - Modification [UC]. All outgoing
               requests for registration of an order for the
               purpose of modification under the Uniform
               Interstate Family Support Act.


STAFF COMMENT:  May 20, 1997, these amendments are made to
provide for the implementation of the Uniform Interstate Family
Support Act, which is effective June 1, 1997.  This Act was
adopted so that Michigan would be in compliance with the federal
Personal Responsibility and Work Opportunity Act of 1996.

     The amendment to MCR 3.214 makes it clear that the circuit
court friend of the court office is responsible for sending
various notices required by the Uniform Interstate Family Support
Act.  The amendment to MCR 8.117 provides new case classification
codes for actions filed pursuant to this Act.
